  1. Introduction
    • These general STV Competition, Prize Draw and Voting Terms and Conditions ("Competition Terms") apply to all competitions, prize draws, votes and polls (each referred to in these Competition Terms as a "Competition") promoted by the Promoter in any media including, without limitation, television and radio programmes, and otherwise online, mobile, apps, and/or social media. Please see Condition 14 at the end of these terms for details of the STV Promoters).
    • The Competition Terms apply in addition to any bespoke terms and conditions ("Rules") relating to a specific prize which is included within any promotion of, or message about, that specific Competition ("Competition Promotion"). Together these Competition Terms and the Rules shall be referred to as the "Engagement Terms and Conditions”.
    • In the event of any inconsistency between the Competition Terms and the Rules, the Rules shall prevail.
    • The Engagement Terms and Conditions may be amended by the Promoter at any time without prior notice. Updated Engagement Terms and Conditions will be published by the Promoter on the website set out in the Competition Promotion.
    • It is the entrants’ responsibility to ensure the applicable Engagement Terms and Conditions are read and understood before entering any Competition. By taking part in the Competition, entrants accept and agree to the Engagement Terms and Conditions. If entrants do not agree with any of the Engagement Terms and Conditions, then entrants should not take part in the Competition.

Unless otherwise stated in a Competition Promotion, the following general terms and conditions apply to all STV Competitions.

  1. Eligibility (General)
    • Entrants must reside in the UK, Channel Islands or the Isle of Man, and must be aged 18 years or over at the time of entry.
    • Entrants must meet the eligibility requirements as specified in the Engagement Terms and Conditions. By entering the Competition, you confirm that you are eligible to enter.
    • The Promoter reserves the right in its sole discretion to ask for evidence to verify the age, identity, and/or eligibility of an entrant at any time, and to use any channels and methods available to carry out checks of any information provided.
    • Entrants must provide evidence of eligibility when asked to do so.
    • In the event that the Promoter is unable to verify your eligibility, the Promoter has the right to reject and disqualify your entry.
    • The following are ineligible to enter an STV Competition. Any such entries will be invalid:
      • employees of the Promoter or the STV group of companies and/or those associated with the operation or promotion of the Competition, including without limitation the provider of the prize and/or the producer of the programme or promotional material.
      • any person or employee of any company that is professionally connected with the Competition or its administration, including without limitation the provider of the prize; and
      • immediate family members (including any live-in partners) of 2.6.1 or 2.6.2

Eligibility (via paid entry method)

  • Where an entrant enters a Competition through a promoted paid route of entry (via SMS/text or otherwise):
    • Entrants must enter using a valid UK geographical landline (beginning 01 or 02) or mobile telephone number (beginning 071-079).
      • Please note that use of a non-geographical number to enter (including without limitation numbers beginning 03,05,070,08 or 09) is likely to be treated as an attempt to manipulate the Competition (in line with [Condition 4.4 to 4.6 below) and may result in such entries being invalid and/or the forfeiture of any prize.
    • The Promoter must have received evidence of payment of any costs relating to the entry by the time the Promoter selects a winner.  
    • Any entry made without a valid payment will be incomplete, invalid and ineligible to win the prize.

 

  1. Entry and Methods of Entry
    • Entrants must submit your Competition entry in accordance with the instructions specified in the Competition Promotion.
    • Entrants may only submit Competition entries on their own behalf. They must not submit entries on behalf of anyone else.
      • Entrants should contact the Promoter [at enquiries@stv.tv] if any assistance to enter required. See Condition 14 for Promoter contact details.
    • Where entry to the Competition is restricted to STV Player registered users only, or where a free entry route is available to STV Player registered users, entrants must be registered with the STV Player at the time of entry and at the time of the winner selection. (Information about STV Player registration is available at: https://www.player.stv.tv/)
    • Entry to the Competition is limited to one entry per entrant.
    • Where the Internet is used as a method of entry to the Competition, entrants understand that internet service provider charges may apply. It is the entrants responsibility to ensure these charges are paid for.
    • Entries must be received by the Promoter within the “Competition Period”, which is the period of time between the opening and closing date and time set out in the Competition Promotion. Where an open date is NOT specified in the Competition Promotion the Competition opens on the day and time it is first promoted and/or published on any media platform.
    • Entries received outside the Competition Period will be automatically disqualified. Where entry is made outside the Competition Period using a paid entry route, the entry will not be counted but it may still be charged.
    • Entrants must answer questions, complete tasks and submit information as required or otherwise set out in the Competition Promotion.
    • Entrants may be required to provide their contact details, including their name, phone number, email and/or other method of contact and/ or any other information as specified in the Competition Promotion to enter a Competition. Once provided, the information cannot be amended.
    • Entrants will be charged the cost of entry (if any) as set out in the Competition Promotion. Costs include entry and/or delivery costs, including taxes (where applicable). Where entry charges apply, the entrant must have the permission of the bill payer before entering the Competition.
    • The Promoter cannot guarantee that entries received from outside the UK by eligible residents will be entered and charges will depend on the relevant service provider’s international rates. The Promoter gives no warranty that the service will be available, legal or appropriate for use in locations outside the UK.
    • Entry to the Competition must be by the method indicated in the Competition Promotion only. This may include one or more of the following:

 

  • Online Entry: Entrants must follow the instructions on the Competition Promotion, including on the relevant STV website or online environment.
    • You will need to be a registered STV Player User to enter online.
    • Internet service providers’ fees may apply when accessing the internet.
    • Online entry is subject to the relevant STV website’s terms of use. By using the relevant STV website to enter, entrants also agree to the STV Terms of Use available at: https://my.stv.tv/terms-of-use/

 

  • Telephone Entry (standard rates). Telephone may include IVR (Interactive Voice Response):  Entrants must call the phone number set out in the Competition Promotion and follow the instructions (where applicable) given in any recorded message.
    • Call charges will be the cost set out in the Competition Promotion plus any applicable network access charge. The total cost will be dependent on the entrants’ telephone network.

 

  • SMS/Text Entry (standard rate or premium rate as applicable): Entrants must send an SMS to the short-code and follow the text entry instructions exactly as set out in the Competition Promotion.
    • The charge per SMS/Text will be the cost indicated in the Competition Promotion plus any applicable standard network charges. The total cost will be dependent on the entrants SMS network.
      • Pre-Pay Customers: Charges will be deducted from the entrant’s available credit.
      • Monthly Pay Customers: Charges will appear on their monthly statement.
      • SMS/Text entrants will receive an SMS text message confirming their entry.
      • SMS/Text entrants may also receive marketing messages about the programme, its sponsor or other services relating to the promotion (unless they have opted out of receiving such messages).
      • SMS entrants can opt out of receiving marketing messages at any time (please see Condition 10.3.1 of these terms and conditions). 
    • Should an entrant believe they have entered a Competition by SMS/text in error and would like a refund of the entry, the entrant must contact the Promoter at [enquiries@stv.tv] at least 24 hours before the winner selection period (referred to at Condition 6 below). Upon receiving your request, the Promoter will endeavour to remove the entry from the relevant Competition and, where successful, will refund the costs of the applicable entry. Any requests received after the winner selection has been conducted will not be refunded.

 

  • Where a paid entry is made, entrants are agreeing to the Promoter starting the Competition service immediately and any statutory rights to withdraw from or cancel the entry purchase (including but not limited to under the Consumer Contracts (Information Cancellation and Additional Charges) Regulations 2013) will be lost because the performance of the services is simultaneous or begins immediately once the purchase is complete.
  • STV Audio is registered with Ofcom, the regulator of Controlled Premium Rate Services in the UK and complies with the regulation outlined in their ‘Regulation of Premium Rate Services Order 2024’.   • Postal Entry: Entrants must include their contact details (including name and a contact telephone / mobile number or other method of contact (as applicable), as well as other information and/or material (as requested)) to the postal address set out in the Competition Promotion.
    • Entries must be sent on a postcard or within an envelope.
    • Entries received on anything other than a postcard or an envelope will not be accepted.
    • In the case where multiple entries are received in a single envelope, only one entry will be entered into the Competition.
    • Entries sent by post must be received at the postal address by the closing date and time for receipt of the postal entries set out in the Competition Promotion.
    • Postal entries without sufficient postage paid will be deemed invalid and will be disqualified.
    • Personal and hand delivered postal entries will not be accepted and will be disqualified.

 

  • Radio (On-Air) Competitions
    • Entrants understand and agree that, whilst there may be a delay in transmission of a radio programme, the delay does not impact the “Competition Period”.
    • Where entrants are invited to call into the Promoter radio station to enter a Competition, the call may be directed to the Studio live or after the call or it may be recorded and used by the Promoter to contact the entrant to confirm entry or notify the entrant that they have won the Competition.
    • In the event that the Promoter is unable to contact the entrant, where the entrant is not available to talk, is unable to answer promptly, or if the line connection is broken or dropped at any time during the call, the Promoter reserves the right discount the entry and to proceed to the next caller to participate in the Competition.   
    • By entering the Competition, entrants agree that audio recordings of entrants off-air may be broadcast on STV’s services on-air, online or on our social media pages at a later date and time, at the sole discretion of the Promoter. Such recordings will take place only after the Competition Period is closed.

 

  • Entries must not be sent via agents, third parties or on behalf of another person. Bulk entries are also not accepted. Such entries will be considered void and cannot be accepted.
  • Any entries which exceed the maximum number of entries permitted for each method of entry as set out in the Competition Promotion, or are otherwise incomplete (including those which do not include all the required information), inaudible, incomprehensible, incorrectly submitted, lost, damaged in any way, are received after the deadline for receiving entries has passed, are not received by the Promoter at all, or are not submitted in accordance with the Engagement Terms and Conditions, will be deemed are invalid and will be discounted.
  • In the event of any fault, mistake, misunderstanding or dispute concerning the correctness or acceptability of any answers given by entrants to a Competition or the operation of any part of the competition or prize draw service, networks or systems, the decision of the Promoter shall be final.
  • Where entrants are required to submit a contribution (which may include but is not limited to photograph(s), video, audio, live-media images, drawings and/or other similar designs) as part of their entry, by submitting the entry, entrants agree to any additional terms set out within the Competition Promotion. Entrants are advised to send copies of material rather than original material as such material will not be returned.

 

  1. Conditions of entry
    • Qualifying entries which comply with the Engagement Terms and Conditions will be accepted and entered into the Competition.
    • The Promoter will not accept responsibility for any Competition entry that is lost or delayed in transit, regardless of reason or cause.
    • The Promoter will not accept proof of transmission as proof of entry in the Competition.
    • The Promoter will not accept competition entries that are:
      • automatically generated by computer or completed by third parties or otherwise submitted in bulk; and where relevant are illegible, altered or tampered with or are incomplete.
    • The Promoter reserves the right to disqualify any entrant if it considers, at its discretion and acting reasonably, that any entrant has used improper technical means to enter.
    • If the Promoter believes, acting reasonably, that any Competition entrant is not an eligible entrant, the Promoter is entitled to disqualify that entrant from the Competition. By entering a Competition, entrants confirm that all information submitted is accurate and complete.
    • In addition to the above, the Promoter reserves the right to disqualify an entrant whose conduct is contrary to the spirit or the intention of the Engagement Terms and Conditions.

 

  1. The Prize
    • The Prize is as specified in the Competition Promotion.
    • Each entrant is limited to winning one prize per Competition.
    • Where a Prize contains multiple components, the Prize must be accepted in its entirety. For the avoidance of doubt, the Prize cannot be separated.
    • The prize is subject to availability and to winner confirmation where the Promoter has managed to contact the winner to confirm eligibility and acceptance.
    • The prize is subject to the terms and conditions of the prize provider, their agents and, where applicable, to the terms of any resort, venue, and/or manufacturer.
    • There is no cash alternative. The prize is not negotiable, non-transferable and non-exchangeable. No alternative prize will be given at the request of the winner.
    • The Promoter reserves the right, in its absolute discretion, to substitute the prize with a prize of equivalent or greater value in the event that the prize is no longer available. This includes where a prize is supplied by a third party where circumstances beyond the Promoter’s control makes it necessary to substitute the prize.
    • The Promoter reserves the right to prevent an entrant from winning more than one prize valued at £500 or more in any six (6) month period. The Promoter reserves the right to disqualify an entrant from entering future Competitions during the six (6) month period.
    • The Promoter may, at its’ sole discretion, award bonus entries for entering a Competition. The Promoter does not accept any liability in the event that a bonus entry cannot be used. Bonus entries can be withdrawn by the Promoter at any time without notice at its sole discretion.

Cheques, Vouchers, Giftcards

  • Where the prize includes a cheque, voucher, or giftcard, the prize will be made payable in pounds sterling in the name of the winning entrant only. The cheque, voucher or giftcard cannot be made payable to any third party. No other form of payment other than that set out in the Competition Promotion will be provided to the winner.
  • The Promoter, prize provider, the issuer of the vouchers or giftcards and/or their agents, reserve the right to refuse to accept vouchers and/or giftcards which are deemed to have been tampered with, defaced, duplicated, damaged or which otherwise are suspected to have been affected by fraud or which have been lost or stolen following delivery.
  • Where the prize includes a cheque, voucher, or giftcard, the prize must be redeemed before the expiry date set out in the Competition Promotion.

Travel and Accommodation

  • Where a prize includes travel or accommodation, the prize will be subject to availability. Certain dates may be excluded when the winner may not take up the prize.
  • Where the prize involves elements including travel and/or accommodation on a date and/or to a destination to be chosen by the winner, the Promoter reserves the right to determine a final date by which the prize must be taken.
  • Where a prize requires travel and/or attendance at an event on a specific date, the winner must be available on the date(s) specified in the Competition Promotion. No alternative dates will be available.
  • All elements relating to a prize, including travel and/or accommodation must be taken up during a single period, and not on non-consecutive dates.
  • Where the prize includes travel for more than one person, the winner and their companion(s) must travel together, departing from and returning to the same location at the same time and on the same itinerary.
  • Where travel dates are restricted or specified in the Competition Promotion, the prize is only available for travel within the restricted and/or specified dates. Where travel dates are not restricted or specified, all travel and holiday prizes must be taken within one year of the date of the winner being selected. Dates, once notified to travel agent, cannot be changed.
  • Entrants are solely responsible for any costs and expenses that are not specified in the prize description but are otherwise incurred by the entrant. For the avoidance of doubt, costs and expenses include travel, insurance, taxes, spending money, airport transfers, and visas. The Promoter does not accept any responsibility for any such costs or expenses.
  • Where a prize involves travel to or from a prize destination, the winner is responsible for ensuring that they (and their companion(s) where applicable):
    • are available to travel
    • hold valid passports (where necessary) with an expiry date of at least six (6) months, together with any necessary visas and travel documents for the holiday in question on the travel dates specified
    • have travel insurance, holiday insurance and health insurance as necessary to use the prize
  • The prize Provider and/or their agents cannot guarantee that seats will be adjacent to each other.

Events, including Ticketed Events

  • Where the Prize involves attendance at, or tickets to an event, the winner acknowledges and understands that the Promoter is not liable or responsible if any part of the event is cancelled, varied or re-scheduled for any reason. In the event that the winner cannot attend the event, the Promoter is under no obligation to provide any cash or tickets to an alternative event.

All prizes

  • Where a Competition prize is provided by a third party ("Prize Provider"), the winner may be required to complete additional formalities with the Prize Provider. For example, the winner may need to complete booking forms or sign up to and abide by the Prize Provider’s terms and conditions. The Promoter shall not be responsible for any acts or omissions of the Prize Provider or any other third party.
  • Prizes are awarded at the Promoter’s discretion. Prizes will not be awarded in the event of improper actions by the winner or any individual acting on their behalf.
  • Not all Competition prizes are suitable for everyone. For example, some prizes may consist of items to be used for physical exercise or leisure activities. It is the winner’s responsibility to ensure that they are suited to use any Competition prize as it is intended to be used and to ensure that they understand how any such items work and their intended purpose and mode of operation. If the winner is unsure as to their suitability to use any Competition prize that involves physical activity, the winner should consult their own doctor or medical practitioner.
  • By entering any Competition, entrants agree to provide any additional personal information requested by the Promoter. For example, the Promoter may need an entrant’s name, telephone number and address, which is necessary to deliver the prize or validate identity and eligibility to enter the Competition.
  • The winner (and where applicable, their companion(s)) is (are) required to comply with all instructions and requirements as may be specified by the Promoter or any authorised third party to receive and/or take up the prize, including but not limited to providing responses within specified time frames, adhering to the itinerary, completing any required forms and delivering any required documentation.
  • The Promoter will not be liable to the winner or any other persons where they fail to comply with instructions and requirements (referenced above at Condition 5.23) such failure may result in forfeiture of the prize.
  • The winner (and where applicable their companion(s)) may be required to provide their signature as proof of their agreement to relevant waivers, releases and/or consents when taking up the prize. Failure to sign any relevant documentation may result in forfeiture of the prize.
  • The prize excludes all other costs and arrangements not expressly included in the prize description as set out in the Competition Promotion. Additional charges and expenses incurred for goods, services, attractions, facilities, upgrades, activities and events not expressly included in the Competition Promotion are payable solely by the winner (and their companion, where applicable).
  • The Promoter will not be held liable where such charges and/or expenses are incurred, and no refund or reimbursement will be made. The Promoter will accept no responsibility where the winner is unable to pay in full any such charges and/or expenses.
  • For delivery of the prize, the winner may be required to be available at a specified time and place.
  • Should the winner accept the prize and decide to sell it on at a later date (where such onward sale is permitted by the Promoter) the Promoter will not be required to provide any guidance on such sale. The winner acknowledges and accepts that the onward sale price may be lower than the retail or advertised price.
  • The Promoter reserves the right to change the prize or any part of the prize to an alternative of equal or greater value for any reason in its sole discretion including without limitation due to circumstances beyond its control or if any part of the prize becomes unavailable.
  • If for any reason the winner chooses not to take up the prize or any part of the prize, the Promoter reserves the right to ask the winner to confirm this in writing and, whether or not such confirmation is received, the Promoter will be able to retain or dispose of the prize (or part of the prize) at its own discretion.
  • The Promoter may refuse to provide a prize or seek its recovery, in the event of non-eligibility, non-entitlement under the interaction terms and conditions or an entrant's breach of the interaction terms and conditions, fraud or dishonesty, including but not limited to the use of technology which enables an entrant to evade applicable charges when entering the promotion.
  • The Promoter or the prize provider (as applicable) will deliver the prize to the winner within 28 days from the winner acceptance. Where the prize is time critical, the Promoter or the prize provider(s) will endeavour to deliver the prize as soon as reasonably practicable before the critical time is expired.
  • The Promoter, prize provider and their agents will not be liable where a prize has been lost, damaged or stolen following delivery and such prize will not be replaced.

 

  1. Winners and Winner Selection
    • Winner(s) will be selected within one week of the closing date and time for all entries.  
    • Where a winner is selected at random from all eligible and correct entries to the Competition, the winner will be selected by either:
      • an automated computer process that undertakes a verifiable random selection; or
      • by an individual who is independent of, and not involved in, the Competition or its administration.
    • Where a winner is selected as a result of a subjective evaluation, for example a creative work including a painting, a photograph or video, the criteria for judging will be set out in the Rules. Selection shall be undertaken by or under the supervision of either:
      • a judge who is independent of and not involved in the competition or its administration (an "independent judge"); or
      • a panel of judges that includes at least one independent judge on the panel who will make the final decision.
        • The names of the judges may be published on the Promoter's website for a period of 30 days after the Competition Closing Date, or will otherwise be made available on request.
        • Where the names are not / or are no longer published, a copy will be available for up to 28 days after the Closing Date of the Competition. Details can be requested by emailing stvenquiries@stv.tvor otherwise in writing to the address set out in Condition 14.
      • Where entries are judged on creative or artistic merit or other subjective criteria, the Promoter and/or the Competition judges (acting reasonably) reserve the right not to select a winner if entries are not of the requisite standard.
      • Where the winner is to be selected by members of the public, for example by casting a vote or taking part in a poll, the winner will be the eligible entrant with the highest number of votes.
      • In the event of a tie-breaker, the Winner will be selected by an independent judge whose decision will be final.
      • In the event that any winner is disqualified from a Competition for any reason, after being selected as the winner, the Promoter shall, in its sole discretion, decide whether a replacement winner should be selected in accordance with the Competition criteria or to cancel the Competition.
      • The Promoter will contact the winner within 14 days of the closing date. The Promoter will contact the winner using the contact details provided at entry. At least three (3) contacts will be made using the contact details provided (including telephone or email) within a three-hour daytime period.
      • Should the Promoter be unable to contact the winner within the time periods set out in Condition 6.8 above, or should the winner fail to meet any of the eligibility requirements, or is unable to comply with the Engagement Terms and Conditions, the Promoter reserves the right to disqualify that entrant (without further liability to the entrant) and offer the prize to the next eligible entrant and thereafter until a winner is found, or otherwise to cancel the Competition.
      • The Promoter does not accept any responsibility if the winner is unable to take up the prize. In such circumstances, the Promoter may, at its sole discretion, reject the winning entry, and choose an alternative winner, selected from the eligible correct entries submitted for that Competition.
      • The decision of the Promoter or the judges nominated by the Promoter relating to the winner selection process is final and no correspondence or discussion will be entered into.

 

  1. Claiming the prize
    • The winner must provide the Promoter with evidence of eligibility on request.
    • The Prize will be delivered to an address within the UK.
    • Should the winner change their address during the Competition Period, the entrant must notify the Promoter before the Competition Period ends and provide evidence of eligibility.
    • The Promoter may withhold delivery of a prize until it has received such evidence from the winner and failure to provide such evidence in a timely manner may result in forfeiture of the prize.
    • Any entrant and/or winner must comply with any directions given to him or her by the promoter, prize provider(s) and/or their agents and with all applicable laws, rules, restrictions, itinerary, and where applicable compliance with Ofcom’s Broadcasting Code. Failure to comply with such directions or applicable laws may result in an invalid entry and/or forfeiture of the prize.
    • The winner must claim the prize within 14 days of acceptance. If the prize is not claimed or accepted within that period, the claim will become invalid.
    • The prize may not be claimed by a third party on the winner’s behalf.
    • The winner should allow 28 days for delivery of the prize. Non-delivery should be notified to the Promoter (at enquiries@stv.tv) on expiry of the 28-day period.  
    • The winner must contact the Promoter within 14 days from the date the prize is received to report any concerns about the quality and/or performance of the prize. Thereafter, the winner is deemed to have accepted the prize as delivered. Any rejected prize must be returned within 28 days of delivery, unless otherwise agreed by the Promoter.
    • The Promoter reserves the right to select a new winner or not award the prize in the event that a prize remains unclaimed.

 

  1. Publishing / Making Available Winner Details
    • Promoters must publish or make available information about winners to show that a valid award took place. By entering a Competition, the winner understands that:
      • the Promoter will either publish the winner’s details on its website or will release the information on request from a member of the public
        • Winner details include the winners’ surname and county only.
        • The Promoter will not publish the winners’ details if thew inner notifies the Promoter that they object to publication, at the time of accepting the prize.
      • The Winner may be asked to participate in any reasonable publicity and promotional activity required by the Promoter, and the Promoter may use the personal data, including name and image, in any publicity or promotional activity, unless the winner notifies the Promoter that they object to the use of their data for this purpose.

 

  1. Liability
    • Notwithstanding Condition 12.1(below) relating to the waiver of statutory cooling period rights where entry is made using a paid method of entry, nothing in the Engagement Terms and Conditions is intended to, or shall be deemed to, restrict a Competition entrant’s statutory rights as a consumer. Entrants should contact their local Trading Standards Office or Citizens Advice Bureau for information about statutory rights.
    • Insofar as permitted by law and subject to Condition 8.1 above, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate entrants or accept any liability for any loss, damage, personal injury or death occurring as a result of entering a Competition or accepting any prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of its employees. Entrant statutory rights are not affected by this condition.
    • The Promoter does not promise that the Promoters’ services, which entrants may need to use to enter a Competition, will be free from errors or omissions nor that they will be available uninterrupted and in a fully operating condition. The services may be suspended temporarily and without notice in the case of any technical issues in relation to any telecommunications or internet network, problem with any system, server, or software, or as a result of any technical malfunction, failure or repair. The Promoter does not accept responsibility where the services, in whole or part, are changed in any way and which affect entry to the Competition.
    • Subject to Conditions 9.1 to 9.3, the Promoter reserves the right to amend any element of a Competition for reasons beyond their reasonable control, including but not limited to the unavailability of the competition entry platform before the closing date, or for strike, lock out illness, natural disaster, act of God, war, riot, epidemic or pandemic, malicious damage, or any incident outside the Promoter’s control, the Promoter is not responsible for any loss or damage caused by the entrant as a result of any of these occurrences.
    • Entrants agree to indemnify and reimburse the Promoter in respect of any damages or losses suffered by the Promoter resulting from any claim by a third party, or any fine imposed upon the Promoter, in respect of any matter, arising from the entrants use of the Promoter’s services relating to the Competition, in breach of the Engagement Terms and Conditions, and/or the Promoter’s Terms of Use, or from the entrants’ non-compliance with any applicable law or regulation.
    • Entrants accept that it is their responsibility to control access to their phone or phone number that is used to enter a Competition. Subject to Condition 9.1 and 9.2, the Promoter shall not be responsible for any loss entrants suffer as a result of the Promoting dealing in good faith with anyone other than the entrant who has access to your phone or any other device using the entrants’ phone number.

 

  1. Privacy
    • By entering a Competition, any personal information provided by an entrant will be held and otherwise processed by the Promoter, their service providers, network operators, suppliers and contractors for the purpose of administering and fulfilling the Competition. By entering the Competition, entrants agree that this includes without limitation, that the Promoter may contact entrants if there is an issue with the Competition Promotion.
    • The Promoters’ privacy notice sets out how personal information is used and is available on the Promoter’s website.  
    • Email marketing messages will only be sent to entrants by the Promoter if the entrant agrees, by “opting in” to receiving such messages.
      • However, where a Competition is entered using a paid entry route such as SMS text messaging, entrants will be sent marketing text messages from the Promoter to the entry device about similar products and services unless / until the entrant ‘opts out’. Entrants can avoid receiving marketing messages by adding NO INFO at the end of the SMS text entry. Entrants can opt out of receiving further SMS text marketing messages at any time by texting ‘STOP’ to the number set out in the Competition Promotion at no extra cost.
    • When entering the Competition, entrants may be asked to agree to receive marketing communications directly from a named Prize Provider by a method specified in the Competition Promotion. Where an entrant agrees to receive such marketing communications, their name and the contact details will be shared with the Prize Provider. Use of the shared personal information by the Prize Donor will be subject to the Prize Provider’s privacy notice and a link to access their policy will be included in the Competition Promotion.
    • By taking part in the Competition, the winner agrees to participate in publicity at the Promoter’s request. The Promoter may, in its sole discretion, use the winner’s (and if applicable their companions’) name, image, comments relating to the prize, and their experience, for future promotional, marketing, and publicity purposes in any media worldwide without notice and without any fee being paid – unless the winner has informed the Promoter that they do not want to participate in such promotion. Winners can opt out by contacting the Promoter at: enquiries@stv.tv.
    • Records of enquiries and responses about the Competition will be retained by the Promoter in accordance with their privacy notice.
    • Communications received by the Promoter by phone may be recorded to ensure that telephone entries are captured accurately, for staff training, quality control, and audit purposes.

 

  1. Use of materials submitted by entrants as part of their entry
    • Unless otherwise agreed, the Promoter does not claim any rights of ownership in any materials that are included with, or that form part of, a Competition entry. As such, as between the entrant and the Promoter, the entrant retains ownership of the entry and the entrant authorises the Promoter to use the entry and any materials forming part of it, for the purposes of:
      • operation of the Competition for which it was submitted;
      • any publicity or reporting of that Competition or any of the Promoters’ Competition-related activities; and
      • selecting a winner for that specific Competition.
    • For the purpose of this Condition 11, by entering into any STV Competition, entrants grant the Promoter (and third parties authorised by the Promoter) a non-exclusive, transferable and sub-licensable, royalty-free, perpetual, worldwide, irrevocable licence (for the full period of any rights in the entrants’ Competition entry) for the Promoter to use, reproduce, distribute, display, edit, perform and adapt the entry and each part thereof, for use in all media whether now known or subsequently developed.
    • Where entrants are invited to submit original material to enter a Competition, any materials submitted to the Promoter by the entrant must:
      • be their own original work; and
      • not infringe any other person's rights.
    • In particular, by submitting material to the Promoter, the entrant confirms to the Promoter that their entry and all materials submitted:
      • do not infringe the rights of any person, including without limitation intellectual property rights;
      • do not contravene any entitlement to privacy of any person, and that consent has been obtained from anyone identified within the submission;
      • does not breach any obligation of confidentiality; and/or
      • does not contain anything which is libellous, defamatory, obscene, indecent, harassing or threatening.
    • By submitting the material, the entrant confirms to the Promoter that they have permission to use or feature any other person, any information about those persons, or other third party material contained within the entry. If any person under the age of 18 appears in the Contribution, the entrant also confirms that they have the permission of such person’s parent or guardian. The Promoter reserves the right to seek documentary evidence of such permission.
    • The entrant agrees not to transfer files which contain viruses or other technologically harmful material.
    • The Promoter reserves the right to verify that entries comply with this Condition 11.
    • Please be aware that the Promoter does not accept responsibility for the return of any Competition entries to Competition entrants. This includes those entries consisting of artistic materials or other materials of whatever nature. Please do not submit any materials in entry for a Competition if the materials need to be returned.

 

  1. Other matters relating to Competitions
    • By entering the Competition, entrants agree that they do not have any commercial relationship with the Promoter, the Producer, the Broadcaster or Publisher (as applicable) and that they are not an agent of the same,
    • All decisions of the Promoter in respect of any Competitions are final and binding and no correspondence or discussion shall be entered into.
    • The Promoter reserves the right to hold void, suspend, cancel, or amend the Engagement Terms and Conditions where it becomes necessary to do so, at its sole discretion, and without notice. Any changes will be an amendment to the Engagement Terms and Conditions.
    • In the event of any issues outside the Promoter's reasonable control including, but not limited to, war, terrorism, riot, civil commotion, accident, breakdown, damage to machinery or equipment or technology, fire, floods, snow, acts of God, strikes, regulatory, legislative interference, ruling or decision which prevents the Promoter from operating any Competition, or providing a prize either as originally planned or at all, To the extent permitted by law and subject to Condition 9 above, the Promoter shall not be liable in any way for any losses or damages suffered or incurred by the entrant as a result of any such occurrence.
    • If an entrant is unsure about any of these Engagement Terms and Conditions, they should seek independent legal advice.

 

  1. Competitions promoted on social media platforms
    • By entering a Competition promoted on a social media platform, entrants must also comply with the social media platform service rules, for example, Twitter or Facebook Rules. The Promoter shall not be responsible for any acts or omissions of the Social Media platform service.
    • Facebook
      • By entering or participating in a Competition on Facebook:
        • Entrants agree that they are providing information to the Promoter and not to Facebook.
        • Entrants understand and agree that they are required by Facebook to comply with Facebook's Terms of Use. The Promoter shall not be responsible for any acts or omissions of Facebook.
      • The Competition (including the Competition Promotion) is not sponsored, endorsed or administered by or associated with Facebook. By entering and participating in a Competition using Facebook, entrants are agreeing to release Facebook of any responsibility of damages that could possibly occur as a consequence of the entrants participation.

 

  1. The Promoter of each Competition
    • The Promoter of an STV competition is the party legally responsible for administering it. STV competitions are currently promoted by STV Central Limited (Company Number 172149) or STV Audio Limited (Company Number SC854513), both of Pacific Quay, Glasgow, G51 1PQ, unless stated otherwise in the Promotional Material or the Rules.
    • The Promoter can be contacted in relation to any STV Competition by e-mailing enquiries@stv.tvor by writing to us at Competitions, STV, Pacific Quay, Glasgow G51 1PQ. In all correspondence, please state the name of the competition, the Promoter, and the STV service it was promoted on.

 

  1. These Engagement Terms and Conditions are governed by and shall be construed in accordance with Scots law and the Scottish Courts shall have non-exclusive jurisdiction.
